Non-lawyer reasoning? If any other person on the deed commits an actionable tort (i.e., something for which he can be sued), then the property can be lost.
Imagine that your spouse is walking down a street, trips, falls, and hurts someone on the way to the ground. The injured party sues. If a jury says your spouse are one percent responsible for the accident, the entire value of the home can be lost.
It is a horrible situation that the lawyers of our state (and probably all other states) have not addressed.
